2022 Seahawks Draft Party Ticket Terms And Release Waiver

THESE TICKET TERMS AND CONDITIONS CONTAIN A BINDING ARBITRATION PROVISION AND CLASS ACTION WAIVER AND OTHERWISE AFFECT THE HOLDER'S LEGAL RIGHTS. by accepting these terms before an event, OR USING OR tendering this ticket and entering the Venue, THE Holder is deemed to have read these Terms, agreed to be bound by them, and signed this DOCUMENT.

Applicability of Terms and Conditions

This ticket is a revocable license that grants the Holder a one-time admission to the Hyatt Regency Lake Washington located at 1053 Lake Washington Blvd N, Renton, WA 98056 (the "Venue") to attend the 2022 Seahawks Draft Party (the "Event"). The person using or tendering this ticket, or otherwise seeking admission to the Event pursuant to this ticket (the "Holder"), agrees that such license is subject to and governed by these terms and conditions ("Terms"). Failure to comply with any of these Terms shall result in forfeiture of this license and waiver of all rights arising hereunder and shall entitle Football Northwest LLC (d/b/a Seattle Seahawks) ("FNW") to pursue all available remedies. FNW may, in its sole discretion, refuse or revoke admission or eject the Holder for any reason.

Compliance With Applicable Policies

Holder must comply with FNW's policies, including security policies, codes of conduct, health and safety policies and assessments, and bag policies. Holder and his/her belongings may be searched and/or assessed prior to and/or upon entry into the Venue and/or other security checkpoints. Prohibited items may be confiscated and/or Holder may be denied admission or have admission revoked at any time at the sole discretion of FNW. Holder consents to all such searches and assessments and waives all claims related to them. If Holder refuses to submit to any such search or assessment, Holder acknowledges that FNW has the right to deny admission or to eject Holder from the Event. FNW reserves the right to deny admission to or eject any person who, in FNW's sole discretion, violates these Terms or any applicable code of conduct, poses a risk to the health and safety of other attendees, or is otherwise disorderly.

Assumption of Risk; Release, Waiver, and Covenant Not to Sue

HOLDER VOLUNTARILY ASSUMES ALL RISKS, HAZARDS, AND DANGERS INCIDENT TO THE EVENT, including the risk of personal injury and death, exposure to communicable diseases, viruses, bacteria, or illnesses or the causes thereof, or lost, stolen, or damaged property, whether occurring before, during, or after the Event, however caused, and hereby waives all claims and potential claims relating to such risks, hazards, and dangers.

Holder releases and covenants not to sue FNW, the National Football League ("NFL"), and their respective affiliates, designees, licensees, agents, owners, officers, directors, employees, and contractors (and all employees of such contractors) (collectively, the "Released Parties") with respect to any and all claims that Holder may have (or hereafter accrue) against any of the Released Parties that relate to any of the risks, hazards, and dangers described above.

Right of Publicity

Holder grants irrevocable permission to FNW, the NFL, and their respective sponsors, licensees, advertisers, broadcasters, designees, partners, and agents to capture, use, publish, distribute, edit, modify, and/or alter Holder's image, likeness, voice, actions, and statements in any medium, including any marketing materials, audio, video, film, photographs, social media, exhibition, transmission, publication, or reproduction of the Event, for any purpose without further authorization or compensation, and Holder waives all claims and potential claims relating to such use unless, and only to the extent, prohibited by law.

Arbitration and Class Action Waiver

ANY DISPUTE, CLAIM, OR CAUSE OF ACTION IN ANY WAY RELATED TO THIS TICKET OR THE EVENT SHALL BE RESOLVED BY MANDATORY, CONFIDENTIAL, FINAL, AND BINDING ARBITRATION IN A MUTUALLY AGREED UPON LOCATION. HOLDER AND FNW AGREE THAT ALL DISPUTES SHALL BE ARBITRATED ON AN INDIVIDUAL BASIS AND WAIVE ANY RIGHT TO LITIGATE OR ARBITRATE ANY CLAIM AS A CLASS ACTION, REPRESENTATIVE ACTION, OR CLASS ARBITRATION. IF HOLDER DOES NOT CONSENT TO THIS CLAUSE, HOLDER MUST LEAVE OR NOT ENTER THE VENUE. THIS CLAUSE, INCLUDING ITS INTERPRETATION AND ENFORCEMENT, IS GOVERNED BY THE FEDERAL ARBITRATION ACT.

Other Terms

These Terms are intended to be interpreted to the broadest extent permitted by law. If any part of these Terms is held to be unenforceable, then that part is to be construed by modifying it to the minimum extent necessary to make it enforceable, and the rest of the Terms shall remain in full force and effect as written. "Including" means "including, without limitation." In the event of any conflict or inconsistency between these Terms and any other terms and conditions related to the Holder's use of this ticket, these Terms shall supersede and govern to the extent of such conflict or inconsistency.

Football Northwest LLC d/b/a Seattle Seahawks ("FNW") is pleased to host the 2022 Draft Party events (each an "Event" and collectively, the "Events") on April 28, 2022 at the Hyatt Regency Lake Washington, located at 1053 Lake Washington Blvd N, Renton, WA 98056.BY PARTICIPATING IN THE EVENT, THE BUYER (ON BEHALF OF HIM/HERSELF AND/OR ANY GUESTS FOR WHOM BUYER IS REGISTERING FOR THE EVENT, HEREAFTER COLLECTIVELY REFERRED TO AS "PARTICIPANT"):

i. Hereby expressly acknowledges and agrees that participating in the Event is voluntary and may involve risk of bodily harm, illness, exposure to COVID-19 or its variants, injury, and/or death (collectively, "Harm") to the Participant;

ii. Releases and agrees not to bring any lawsuits nor make any demands nor pursue any complaints against FNW, the National Football League ("NFL") and each of their respective successors, assignees or legal representatives, and any owners, affiliates, officers, members, partners or shareholders (whether direct or indirect), subsidiaries, employees, agents, or any of the foregoing (the "Released Parties") as a result of participation in the Event, wherever, whenever or however the same may occur;

iii. Agrees to fully indemnify and save and hold harmless the Released Parties from any causes of action, suits, injuries, damages, losses, costs, expenses, or liabilities arising from or relating in any manner to Participant's participation in the Event, whether caused by the negligence of any or all of Released Parties, or otherwise;

iv. Assumes full responsibility and risk for Harm to Participant due to the negligence of the Released Parties or otherwise while attending, observing, volunteering at, or for any purpose participating in the Event;

v. Understands that this document is intended to be as broad and inclusive as permitted by the laws of Washington state and agrees that if any portion of this agreement is invalid, the remainder will continue in full legal force and effect;

vi. Agrees that any legal proceeding related to this waiver would take place in Washington state;

vii. Acknowledges that Participant may be photographed, filmed, and/or otherwise recorded (collectively, the "Recording") during the Event, and hereby consents to such Recording; and

viii. Grants to FNW, the NFL, and their respective sublicensees (collectively, the "License Parties"), an irrevocable, royalty-free, fully paid-up worldwide right and license to use the name, image, likeness, voice, biographical information, persona, and any other identifying characteristics of Participant (collectively, the "Publicity Rights") captured, gathered, or provided in connection with the Event, and to create derivative works thereof, in each case, for any purpose and in any media or forum now existing or hereafter developed. Without limiting the generality of the foregoing, Participant acknowledges and agrees that the license to Publicity Rights granted hereunder may be exploited and/or sublicensed by any of the License Parties for commercial, marketing, and promotional purposes.

I have read the above PARTICIPANT WAIVER AND PUBLICITY RELEASE and fully understand and agree to the terms and conditions on behalf of myself and/or my guest. By checking this box, I certify that I am over the age of 21 and acknowledge that I am giving up legal rights and remedies that may be available to me and/or my guest for the actions and negligence of the Released Parties and/or License Parties.
